These are Fullary Market's pre-launch seller terms. They describe the intended transaction rules but do not create a live seller account, public listing, order, commission, or payout.
Status and acceptance
The current Market preview and private creator studio are draft-only. These Marketplace Seller Terms will apply to a seller only if Fullary later enables transactions for that seller and the seller expressly accepts the then-current agreement during activation. Creating a private draft does not constitute acceptance, approval, onboarding, or a promise that selling will become available. Fullary's general Terms govern current use of the draft tools.
Seller eligibility and verification
A prospective seller must provide accurate identity, business, ownership, tax, and bank information required by Fullary or the approved marketplace payment provider; complete all applicable KYC or KYB checks; use an eligible account in an enabled country; and keep that information current. Supported seller types, countries, currencies, payment methods, and required documents will be shown during onboarding. Fullary does not currently promise eligibility for any individual, company, or country.
Listings and buyer disclosure
Each listing must accurately identify the seller and state the exact deliverable, format, quantity or scope, material limitations, compatibility requirements, license, price, taxes where shown, and delivery method and timing. A service or physical-item listing must also state the service boundaries or shipping conditions that apply. Sellers must not use fabricated testimonials, hidden conditions, misleading previews, false scarcity, guaranteed outcomes, or claims that a product is human-created when material AI assistance should reasonably be disclosed.
Ownership and AI-assisted content
The seller retains rights the seller holds in an offer and grants Fullary only the limited permission needed to review, display, market, deliver, support, and administer it. The seller must own or have sufficient commercial rights to every included text, image, recording, file, dataset, brand element, likeness, and other asset. The seller remains responsible for an AI-assisted output, the inputs used to create it, its accuracy and safety, and any disclosure or permission it requires. The seller must follow the Restricted Products, AI Content and IP Policy.
Price, platform commission, and provider fees
Before a seller activates a listing, Fullary will disclose the listing price controls, Fullary's platform commission, applicable payment or payout fees allocated to the seller, settlement currency, and available payout schedule. A private draft's intended price is planning information only. No marketplace commission is currently charged. Fullary will not manually collect buyer funds and redistribute them to sellers; a live transaction must use an approved marketplace payment flow.
Orders, delivery, and support
After activation, a seller must deliver the advertised product or service within the terms shown to the buyer, keep reasonable evidence of delivery and rights, respond to order questions, and cooperate with refunds, disputes, fraud reviews, chargebacks, recalls, or legal requests. The seller must not move a Fullary order off-platform to evade applicable controls or commission. The separate Marketplace Delivery, Refund and Dispute Policy will apply to enabled transactions.
Taxes and legal compliance
The seller is responsible for determining and meeting the seller's registration, licensing, invoicing, reporting, income-tax, VAT, customs, consumer-protection, product-safety, and other legal obligations unless a written checkout term expressly assigns a particular collection or remittance duty to Fullary or the payment provider. Marketplace statements are not tax or legal advice. A seller may be required to provide tax documentation before activation or payout.
Review, restriction, and removal
Fullary may review, reject, limit, unlist, suspend, preserve evidence about, or remove an offer or seller account when reasonably needed for safety, rights, provider rules, legal compliance, inaccurate disclosures, poor delivery, excessive disputes, or breach of these terms. Fullary may pause a listing or seller while a complaint or payment review is unresolved. Any payout restriction is also subject to the approved provider's compliance and risk controls.
Privacy and records
Seller onboarding and transaction data will be handled as described in the Privacy Notice. Identity or bank documents must never be added to the current private-draft fields or sent in ordinary support email. If marketplace onboarding opens, Fullary will identify the secure collection route and the entities processing that information.
Termination and continuing obligations
A seller may stop offering future products subject to unresolved orders, refunds, disputes, chargebacks, legal holds, and obligations already accepted. Rights, payment, tax, record, indemnity, dispute, and enforcement provisions that by their nature must continue may survive closure. Final suspension, termination, liability, and governing-law language will be presented for express acceptance before transactions are enabled.
